You are signing up to play at one of the fields participating in NYC Open Play, late night pickup soccer from the Office of the Mayor. The goal here is to make soccer available to New Yorkers late into the night. No instruction, just field access for you and your friends.

All players must be 18 years of age or older and must complete a waiver prior to play. Once your waiver is signed, you can just show up, no reservation needed. As long as there are other players, our field hosts will work to get you into a game.

If you are playing with a team, you can reserve a slot for your team after signing the waiver. Everyone playing must sign this waiver individually. To make sure your team gets on the field at your scheduled time, Captains (or other team representatives) must show up at least 20 minutes before their scheduled slot to check in. If there is a line to play when you arrive, you may be asked to wait. Our Field Hosts will work to slot in any free agents into available room in games and we ask you to be willing to make new friends who want to get on the field with you.

WAIVER AND RELEASE OF LIABILITY

In consideration of being permitted to participate in any activities, leagues, practices, tournaments, or events (collectively, the “Activities”) organized, operated, or sponsored by The Footy League Corp, The Footy League NYC LLC (TFL), and its subsidiaries and related entities, successors, assigns, officers, directors, employees, volunteers, representatives, agents, event holders, event sponsors, and event officials, the City of New York, New York State, and the respective affiliates, owners, officers, directors, employees, players, coaches, contractors, representatives, agents, sponsors, volunteers, successors, and assigns (collectively, the “Released Parties“) of each entity, I, the undersigned participant, acknowledge, understand, and agree as follows:

  1. Assumption of Risk

I understand that participation in soccer and related Activities involves inherent and significant risks of physical injury (including permanent disability or death) and property damage.

Risks include, but are not limited to, those arising from playing surfaces, facilities, weather, temperature, field conditions, equipment (including defective or malfunctioning equipment), and property owned, maintained, or controlled by the Released Parties, as well as the actions or inactions of other participants, spectators, volunteers, officials, or third parties.

I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Released Parties.

1A. Communicable Diseases

I understand that participation in the Activities may expose me to contagious or infectious diseases, including but not limited to COVID-19, influenza, staph or MRSA, and other airborne or contact-transmitted illnesses.

I knowingly and voluntarily assume all such risks, both known and unknown—including risks that may arise from the acts, omissions, or negligence of the Released Parties or others—and accept sole responsibility for any resulting illness, injury, disability, or death.

  1. Weather and Conditions

I understand that games and events may proceed in adverse weather conditions, including rain, snow, extreme heat, or cold, and that such conditions are inherent to outdoor play. I agree that my participation is voluntary regardless of such conditions.

  1. Compliance and Inspection

I agree to comply with all rules and safety instructions of the Released Parties. I will inspect the facilities and equipment prior to participation and, if I believe anything to be unsafe, will immediately notify an official and refuse participation until corrected.

  1. Health Certification

I certify that I am physically fit and have not been advised otherwise by a medical professional. I am solely responsible for determining whether I am capable of safely participating in the Activities.

  1. Release and Waiver

I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, waive, and hold harmless the Released Parties from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind, including those arising from the negligence of the Released Parties, that may arise out of or relate in any way to my participation in the Activities, my travel to or from them, or my presence at their facilities.

  1. Indemnification

I agree to defend, indemnify, and hold harmless the Released Parties from any and all claims, damages, costs, and expenses (including reasonable attorney’s fees) arising out of my acts or omissions during the Activities, or the acts or omissions of any minor I accompany or supervise.

  1. Medical Treatment

I consent to receive medical care or treatment deemed advisable in the event of injury, accident, or illness during the Activities and release the Released Parties from any liability arising from such treatment.

  1. Media Release

I consent to the photographing, filming, and recording of my image, likeness, and voice (“Recordings”) in connection with the Activities.

I grant the Released Parties the irrevocable right and permission to use, reproduce, edit, alter, copy, exhibit, publish, or distribute such Recordings, in whole or in part, for any lawful purpose including advertising, marketing, promotional, or commercial uses, in any form of media now known or later developed, without compensation or additional approval.

All Recordings shall be the sole property of the Released Parties, and I waive any right to inspect or approve their use or any right to royalties or other compensation.

I understand that the Recordings may appear in media or online publications outside the control of the Released Parties, and I agree not to hold them responsible for any unauthorized reproduction or distribution.

I release and hold harmless the Released Parties, and their advertising and promotional agencies, from any and all claims, demands, damages, or causes of action arising out of or related to the use of such Recordings, including but not limited to claims for libel, defamation, or invasion of privacy.

  1. Governing Law and Venue

This Waiver and Release shall be governed by and construed under the laws of the State of New York. Any claim or dispute arising hereunder shall be brought exclusively in the state or federal courts located in New York County, New York.

  1. Severability

If any provision of this Waiver is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  1. Interpretation

This Waiver and Release shall be construed broadly to provide a release and waiver to the fullest extent permitted by applicable law.

  1. Digital Acceptance

By registering for any TFL program, event, or league—whether online or otherwise—you acknowledge that you have read, understood, and agreed to the terms of this Waiver and Release of Liability, and that your registration constitutes your electronic signature and legal acceptance of this agreement.

Your acceptance is recorded and stored digitally by NYC Footy for verification purposes.

  1. Acknowledgment

I have read this Waiver and Release of Liability, fully understand its terms, understand that I am giving up substantial rights by agreeing to it, and agree to be bound freely and voluntarily. I intend this release to be as broad and inclusive as permitted by law.

  1. Age Requirement

I hereby confirm and certify that I am at least 18 years of age at the time of registration and participation in the Activities. I understand that participation is strictly limited to individuals who are 18 years of age or older. If I am under the age of 18, I am not permitted to register for or participate in any Activities, and any registration completed on my behalf will be considered void.

  1. Code of Conduct

I hereby confirm and certify that I will adhere to the outlined Code of Conduct for all participation in this initiative. As outlined, the Code of Conduct, as prepared by NYC FOOTY in partnership with Women in Soccer (WIS), includes:

Lead with respect and honesty everywhere — on the pitch, in the inbox, and at the post-game bar. This community was built on it, and we protect it at all costs.

I — INCLUSIVE

All players, all identities, all backgrounds are welcome. We foster a diverse, equitable space where everyone can thrive.

C — CALL IT IN

Address issues privately and respectfully, not publicly. Listen, learn, and be a goldfish. Let go of resentments and get back to the game.

K — KEEP IT CLEAN

Play safe. No dangerous play, no abusive language on or off the field. No alcohol on park grounds. Do not participate if you are under the influence — you put yourself and others at risk. Competitive banter is welcome. Disrespect of any person is not.

ZERO TOLERANCE

By completing this waiver, you agree to receive email or text message communications from the Mayor’s Office. You agree that the Mayor’s Office may use this information to share information or communications with you about the Mayor’s Office and Mayor’s Office events.
